The SEC’s new Marketing Rule becomes effective on November 4, 2022. Not only does this Rule redefine Advertisements, but the SEC has also incorporated the old prior solicitor rules into the new Marketing Rule, rescinding Rule 206 (4)-7 along with many of the widely accepted No-Action Letters utilized across the industry. This change has implications for GAMMA members whether they are investment advisors registered with the States or have clients registered with the SEC. Lisa Roth, President of Monahan & Roth, will help members of GAMMA to understand how the new Rule pertains to our members and their clients.
